In some circumstances, there is injury & disability insurance attached to credit cards, personal loans, vehicle finance, mortgages, travel related purchases and Superannuation Funds.  For instance, you may not be aware that your Superannuation Fund has an insurance attached to it which will provide you with income payments for a period when you are injured and cannot work.  One such Super fund that has income protection insurance attached is QSuper. The insurance becomes operative after a 28 day period of inability to work, and pays a wage type benefit weekly or fortnightly whilst you are disabled from work for up to a 2 year period. Another example is where insurances are automatically attached to your credit card, such as in the case of some American Express Credit Cards (Amex) where you claim lump sum payments for certain types of injury (ie. $15,000 for a broken leg).

What is of great assistance when you are injured is where you have injury & disability insurances attached to credit cards, personal loans, vehicle finance or mortgages. Having regular payments you have to meet to pay off loan or credit card balances can be a real problem when you are injured or sick and cannot work.  In some cases these insurances will meet your regular payments over a certain period of time whilst you are disabled, or provide you with a percentage of the outstanding amount on your loan, credit card, mortgage etc., and in other cases the cover is for the total amount or a capped lump sum payment toward your outstanding balance at the time of your injury or disability.

It is particularly beneficial when you have this type of insurance attached to your mortgage, as if you are injured and cannot work, some policies actually kick in to pay your ongoing mortgage payments, and pay out your mortgage.

Partial & Permanent Disability & Total & Permanent Disability Claims

The other type of injury and disability insurance that is more commonly known is where you are paid a lump sum payment when you are permanently unable to work , or you are permanently partially impaired by an injury or medical condition. These insurances are respectively known as Total & Permanent Disability Insurance and Partial & Permanent Disability Insurance.  Often these disability insurances are attached to Superannuation Funds and the Super Fund pays for the insurance premiums as part of annual administration fees, so often people are unaware they have these insurance claims available to them when they are injured.

If you have Total & Permanent Insurance attached to your Superannuation, you could be entitled to be quite a substantial payment if you are unable to return to work because of injury or illness.

It doesn’t matter how you sustained the injury or illness as long as it was not self-inflicted in order to claim

Unlike in personal injury claims where you need to show that your injury has been caused or contributed to by the fault of another, in the case of claiming for insurance payments, this is not necessary.  As long as your injury or medical condition occurred or developed to the point of disablement during the coverage period of your insurance, this is all that is required.  Of course, you will not be entitled to claim if it can be shown that the injury or medical condition arose because of a purposeful act by the claimant, in order to claim under the insurance policy.

Also,  if you have a motor vehicle accident, workplace injury, medical malpractice claim, or any other personal injury claim resulting from the fault of another, your right to claim under any injury & disability insurances, is additional to your personal injury compensation and cannot be taken into account when calculating your damages amount. However, in some limited cases of income protection insurance policies, payments made may be required to be reimbursed to the insurer should you receive a personal injury claim payout.
